RIGHT TO APPLY
No person may be refused the right to apply for housing unless the development’s waiting list is closed for a particular unit size or type, and notice of the closed waiting list with the development’s phone number, TTY number, fax number and email address, has been posted in a prominent, accessible location.

This is an EQUAL HOUSING PROJECT DESIGNED TO PROVIDE AFFORDABLE HOUSING UNDER A FEDERALLY SPONSORED PROGRAM. RESIDENCY IS OPEN TO ALL QUALIFIED PERSONS WITHOUT REGARD TO RACE, SEX, SEXUAL ORIENTATION, MARITAL STATUS, FAMILIAL STATUS, AGE (except for senior citizen housing pursuant to California and Federal Law), COLOR, RELIGION, DISABILITY, MILITARY/VETERAN STATUS, SOURCE OF INCOME, NATIONAL ORIGIN, ANCESTRY, OR ANY OTHER CHARACTERISTIC LISTED OR DEFINED IN SECTION 12955 OF THE CALIFORNIA GOVERNMENT CODE OR SECTION 51 OF THE CALIFORNIA CIVIL CODE AS SUCH SECTION APPLIES TO HOUSING ACCOMMODATONS, OR ANY OTHER PROHIBITED BY LOCAL, STATE OR FEDERAL LAW.

STATEMENT of NON-DESCRIMINATION
It is the policy of El Casa Verde Apartments, herein after referred to as the Owner/ Agent, to promote equal opportunity and non-discrimination in compliance with, but not limited to, the Federal and State constitutions and legislative enactments addressing discrimination in housing including, The Fair Housing Amendment Act of 1998 (Title VI,), 42 U.S.C.A ~ 3601 – 3620, Section 504 of the Rehabilitation Act of 1973, 29 U.S.C.A ~ 794 of 1964, 42 U.S.C.A ~ 2000d, the Age Discrimination Act of 1975, 42 U.S.C.A ~ 6107. The Violence against Women Reauthorization of 2013, and The Equal Access Rule; The Final Rule – Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity is intended to ensure that housing across HUD programs is open to all eligible individuals and families regardless of actual or perceived sexual orientation, gender identity, or marital status.

APPLICATION and WAITING LIST PROCEDURE
Applications will first be reviewed for completeness. Incomplete applications will not be accepted and returned to the applicant. Applications completed in full and properly signed will be accepted and reviewed for income eligibility.

Applications determined ineligible, pursuant to the program guidelines, will be rejected in accordance with procedures outlined above. Once a fully completed application is determined to meet income eligibility requirements and the household composition is determined appropriate for a unit at the development, the applicant will be placed on the waiting list. Applicants who are at the extremely low-income limit have preference and will be placed on the waiting list, by date and time of receipt. If an extremely low-income limit applicant is needed to achieve income targeting requirements, and the next applicant has income above the extremely low-income limit, the applicant must be placed on the waiting list until the property is ready to house an applicant with income above the extremely low-income limit.

• The Owner/ Agent will administer its waiting list in accordance with the following policies:
√The waiting list will be maintained in either a bound ledger or on a computer report. A printed copy of the list will be prepared, prior to the annual update, and maintained for three years.
√The waiting list will be organized by type of unit, (physically adapted unit, etc.).

• Type of unit defined in several ways, including:
√The number of bedrooms, as well as the number of bathroom, or ancillary rooms, such as den or dining room.
•If an applicant is eligible for tenancy, but no appropriate sized unit is available, the applicant will remain on the waiting list without misplacement.

•Households that are eligible for more than on size unit (by bedroom size) may choose to be placed on multiple waiting lists as appropriate and the Owner/ Agent will respect the bedroom size option chosen by the applicant unless such choice violates the state sanitary code, or other applicable laws, or the development’s Occupancy Standards.

•Persons using a wheelchair or requiring similar accommodations may apply for a standard unit, as well as an accessible unit, in their discretion.

•The Owner’s/ Agent’s records will indicate the date and time the application is placed on the waiting list. All records including the application, must be retained for a period of (3) years.

•The Owner/ Agent will update the waiting list every (12) months by sending a letter, to ensure that we have current information (i,e., phone number, the number of members in the family, the amount of income, etc.) or to remove applicants who are no longer interested. If the applicant wants to stay on the waiting list, they must return the letter, indicating that they want to remain on the waiting list within 14 days of the date listed on the letter or the Owner/ Agent will assume the applicant is no longer interested and will remove them from the waiting list.

• It is the applicant’s and current tenant’s responsibility to update the Owner/ Agent to ensure that the Owner/ Agent has the correct information on file.

• The waiting list will be closed for one or more unit sizes when the average wait is one year of more.
Potential applicants will be advised if the waiting list is closed and additional applications will not be accepted. The Owner/ Agent will post a notice at the development that indicates:
√ The date the list will be closing and
√ The telephone number, fax and TDD number for verification.
√ Notice must be in 14 pint (or larger) print and posted in prominent accessible location(s).

•When an applicant pool is no longer adequate due to the closure of the waiting list, the waiting list shall be
re-opened and applications will be accepted again, notice will be published in the local newspaper and at the development in the same manner as indicated above.

• Applicants will be contacted for available apartments according to the following procedure:
√ The first five applicants on the waiting list will be contacted by phone and in writing notifying them of the available unit (or to fill future vacancies) and their position in line for the available unit(s).
√ Each applicant will have 5 business days to respond to the inquiry, view the apartment if they choose, provide current and complete landlord contact information (Note: failure to provide complete and correct landlord information if applicable, will result in the unit being offered to the next qualified applicant).
√ Each applicant that responds within 5 business days will be offered the unit(s) in the order that they appeared on the waiting list.
√ When the unit is filled, each applicant that was not offered a unit will be placed back on the waiting list in their original order.
√ If any applicant responds after 5 business days they will be offered the unit(s) in the order that the request for unit was made.
√ After 5 business days the applicant will forfeit any rights to be offered the unit in the order that they appear on the waiting list. However, they will not lose their place on the waiting list for future offers.
√ If no response is received from the first 5 applicants within the 5 business days time frame the next 5 applicants on waiting list will be processed according to the procedures listed above.
√ Once a unit has been accepted, the Owner/ Agent will conduct a credit, criminal and landlord background check to determine eligibility.
√ If the unit was offered to an eligible applicant, the unit will be offered according to the above procedures.
√ Applicants will be removed from the waiting list if they turn down an available unit for 3 separate occasions.
